These Terms and Conditions ("Terms") govern your access to and use of the 4D Prom application and related services (the "App"), provided by 4-Domain Sports PROM ("we", "our", "us"). By creating an account or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.
Accounts are created directly by us, by a clinic/organization administrator, or through a team invitation. You must provide accurate registration information and are responsible for keeping your login credentials confidential and for all activity under your account.
The App is not directed at children under the age of 16. Registered user accounts are intended for healthcare providers and clinic staff, not for patients directly; patient data is entered by or on behalf of the clinic responsible for that patient's care.
The App is currently offered as a testing/beta version. This means:
Data collected through the App - including questionnaire responses and reports - is accessible exclusively to registered users belonging to the same team/clinic ("Client") that collected it. We do not share one Client's data with another Client. See our Privacy Policy for details on how data is collected, used, and protected.
Access to the App and to the data collected through it is currently provided for a period of 6 (six) months from the relevant account's activation, or from the date these Terms take effect for existing accounts, whichever applies.
This retention period may be changed, shortened, extended, or discontinued at any time, without prior notice, at our sole discretion, while the App remains in its testing phase. Where reasonably possible, we will attempt to notify Clients of material changes to this period, but we are not obligated to do so. We recommend regularly exporting any data you need to retain (available in PDF/Excel from the reporting screens).
We may introduce paid subscription plans in the future. Where offered, an active paid plan may grant lifetime (or otherwise extended) access to the App and to the data associated with your account, for as long as the plan remains active and in good standing. Specific pricing, features, and terms for any such plan will be presented and agreed to separately at the time it becomes available, and are not part of these Terms. Availability of the App under the current free/testing terms, as described in Section 4, does not guarantee any particular price or feature set for future paid plans.
The App is a data collection and analysis tool for Patient-Reported Outcome Measures. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Any clinical decision must be made by a qualified healthcare professional exercising independent professional judgment; the App's outputs (scores, charts, comparisons) are intended to support, not replace, that judgment.

The App, its underlying software, the 4-Domain Sports PROM questionnaire instrument, and all related branding and content are owned by us or our licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for its intended purpose - they do not transfer any ownership rights to you.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, availability, or fitness for a particular purpose - particularly given its current testing phase (Section 2).
To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of, or inability to use, the App, including as a result of the testing-phase conditions described in Section 2.
We may suspend or terminate your account if we reasonably believe you have violated these Terms. You may request deletion of your account at any time through our account deletion request form; see our Privacy Policy for how retained data is handled.
We may update these Terms from time to time, particularly during the testing phase described in Section 2. We will indicate material changes by updating the "Last updated" date above and, where appropriate, through the App itself. Continued use of the App after a change takes effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws applicable in the jurisdiction where 4-Domain Sports PROM operates, without regard to conflict of law principles.
